Is credit card surcharging legal?

Yes, credit card surcharging is legal in most U.S. states. However, it is currently prohibited in Connecticut, Maine, Massachusetts, and Oklahoma. Puerto Rico also prohibits surcharges. Some states like Colorado have lower caps than the standard 3%. Always verify the laws in your state and your customers’ states before implementing a surcharge program.

Can I surcharge debit cards?

No. Card network rules prohibit surcharging debit cards, even if they carry a Visa or Mastercard logo. Your surcharge program must be able to distinguish between credit and debit transactions and only apply the fee to credit cards. Surcharging a debit card, even accidentally, is a compliance violation.

How much can I charge as a surcharge?

Your surcharge cannot exceed your actual cost of acceptance or 3%, whichever is lower. For example, if your effective processing rate is 2.5%, that is your maximum surcharge. The surcharge must also be disclosed clearly to customers before they complete their transaction and appear as a separate line item on receipts.

Do I really need to notify Visa and Mastercard before surcharging?

Yes. You are required to notify Visa and Mastercard at least 30 days before you begin surcharging. Visa has an online registration portal for this. Mastercard requires notification through your acquiring bank or payment processor. Failing to notify the card networks can result in fines or termination of your merchant account.
